Terms of Use for SmartCleno

Effective Date: January 31, 2026

These Terms of Use ("Terms") govern your use of the SmartCleno mobile application (the "Service") provided by CONVOLUTE.AI PRIVATE LIMITED (“we”, “us”, or “our”). By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

Historical Note: SmartCleno was internally codenamed "Smart Media Cleaner AI" earlier in development. Any remaining references to that former codename in documentation or third-party dialogs (e.g., cached OS strings) should be interpreted as referring to SmartCleno.

1. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial purposes on a device that you own or control, subject to these Terms.

2. Intellectual Property Rights

The Service and its entire contents, features, and functionality—including but not limited to all software, source code, AI models, algorithms, text, graphics, logos, and the unique concept and implementation of using an on-device AI model for media cleanup—are the exclusive intellectual and proprietary property of CONVOLUTE.AI PRIVATE LIMITED and are protected by Indian and international copyright, trademark, and other intellectual property laws.

Proprietary AI Models: The Service utilizes proprietary AI models for spam detection and similar image detection. These models are protected assets with verifiable integrity:

Prohibited Actions: You are strictly prohibited from:

Copying, modifying, distributing, selling, or leasing any part of our Service.
Reverse engineering, decompiling, disassembling, or attempting to extract the source code of the Service or any AI models.
Repackaging the application or using any part of our Service, including the AI models for spam detection or similar image detection, to create a derivative or competing product.
Attempting to extract, replicate, or reverse-engineer the proprietary algorithms used for image analysis and similarity detection.

Any unauthorized use, reproduction, or distribution of our intellectual property is a violation of these Terms and applicable law, and may result in severe civil and criminal penalties.

3. Privacy and Data

Your privacy is paramount. As stated in our Privacy Policy, our Service is designed to respect your data:

No Data Collection: We do not collect, transmit, or store your personal files, photos, or metadata on our servers.
On-Device Processing: All AI analysis, spam detection, and similar image detection occurs exclusively on your device.
No Training on User Data: We will never use your images or files to train our AI models.
Enhanced Capabilities: Our updated AI model now supports both spam detection and similar image detection while maintaining complete privacy.

4. Disclaimer of Warranties and "As Is" Service

THE SERVICE IS PROVIDED TO YOU "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND DEFECTS WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, ACHIEVE ANY INTENDED RESULTS, BE COMPATIBLE WITH ANY OTHER SOFTWARE, OR OPERATE WITHOUT INTERRUPTION OR ERROR. THE AI MODELS MAY PRODUCE INACCURATE RESULTS, INCLUDING:

Spam Detection: False positives (flagging a valid file as spam) or false negatives (failing to flag a spam file)
Similar Image Detection: Incorrectly grouping unrelated images or failing to detect actual similar images
Duplicate Detection: Missing exact duplicates or incorrectly identifying different images as duplicates

YOU ARE SOLELY RESPONSIBLE FOR REVIEWING ALL SUGGESTED DELETIONS AND SIMILAR IMAGE GROUPINGS BEFORE CONFIRMING.

5. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CONVOLUTE.AI PRIVATE LIMITED OR ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

LOSS OF DATA, INCLUDING THE ACCIDENTAL DELETION OF PERSONAL OR IMPORTANT FILES;
LOSS OF PROFITS, REVENUE, OR BUSINESS;
ANY DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US, IF ANY, FOR THE USE OF THE SERVICE.

6. User Responsibility and Indemnification

You are solely responsible for your use of the Service and for backing up your important files. You agree to indemnify, defend, and hold harmless CONVOLUTE.AI PRIVATE LIMITED and its affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses arising from your use of the Service or your violation of these Terms.

7. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately. You may terminate these Terms by uninstalling the application from your device.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

You agree that any legal action or proceeding arising out of or related to these Terms or the Service shall be brought exclusively in the competent courts of **Bangalore, India**. You hereby consent to the exclusive jurisdiction and venue of such courts.

9. Severability

If any provision of these Terms is held to be illegal, invalid, or unenforceable by a court of competent jurisdiction, such provision shall be fully severable and these Terms shall be construed and enforced as if such illegal, invalid, or unenforceable provision had never comprised a part of these Terms.

10. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of changes by updating the "Effective Date" at the top of this document. For any material changes to these Terms, we will provide a more prominent notice within the Service before the changes take effect. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
